Man Sentenced in Vehicular Assault on Thornton Officer

Man Sentenced in Vehicular Assault on Thornton Officer

Adams/Broomfield District Attorney Don Quick announced today Fernando Malagon (DOB: 05/22/1992)) was sentenced in for causing serious bodily injury to an on duty Thornton Police Officer.



On September 24, 2011 at approximately 8:00 AM, Thornton Police Officer Joe Dougherty was making a traffic stop using emergency lights and waving over a vehicle on I-25 northbound in the 9100 block.  Malagon swerved into the same lane as the officer and struck the rear of Officer Dougherty’s motorcycle with the front of his jeep.  Witnesses stated that Malagon’s vehicle was seen weaving in and out of traffic prior to the collision. At 9:50 AM Malagon was tested for alcohol and drugs with the results of a .138 blood alcohol level and positive for cocaine.




Officer Dougherty suffered serious bodily injury with a pelvic fracture, abdominal injury and suffered a substantial risk of death.




“This is yet another example of the horrific impact of using drugs and alcohol and deciding to drive,” says District Attorney Don Quick, “I have known Joe Dougherty for many years and I am glad he is alive and making progress in his recovery.”




Malagon entered a guilty plea on March 22, 2011 to Vehicular Assault-DUI (F-4)



Adams County District Court Patrick Murphy sentenced Malagon to three years in the Colorado Department of Corrections.
